TERMS OF SALES

ORDERS

We ask our customers to clearly specify the reference of each model and the finishing information. The options for certain models must be specified when ordering.

Some models are subject to a minimum quantity to be able to validate the order.

Orders are deemed firmly accepted when, after receipt of the order form, we send the confirmation. Be sure to check this document, which corresponds to the production orders.

By ordering the goods, the customer firmly agrees to purchase the goods ordered. Orders can be placed in writing by telephone, but under no circumstances by using two of these methods simultaneously.

The modification of an order is only possible after our agreement if the production or the preparations for production have not started.

Metamorphoses is not obliged to accept the contract proposal inherent in the order within two weeks of its receipt. The conclusion of the contract takes place subject to the proper supply of Métamorphoses by its suppliers, with the correct goods and on time.

Cancellation is only accepted within 15 days after the order confirmation has been issued.

The prices shown on the tariff are indicated in Euros and include VAT with the amount of French VAT in force at the time of invoicing. Invoicing during the day of delivery.

Confirmed delivery times are always ex-factory. They are only given as an indication and can in no case, being exceeded, be the subject of damages or refusal.

In the event of a dispute, we kindly ask you to send us by email, fax or post the subject of the after-sales service, accompanied by the photo illustrating the problem. We do not accept any deductions or invoicing without prior agreement.

The GCS can be consulted by the customer on the site www.ateliermetamorphosescreations.com on the shop page. On request, we also send these GTCs by e-mail and by post.

Sending fabric samples is possible on customer request. These fabric samples cannot be sold and must be returned to Metamorphoses intact and in their original packaging within one month.

TRANSPORT and SHIPPING

All items are packed in a cardboard box by 1 or 2 depending on the case (a plastic film or a

cardboard folder separates them) or under a special cover. We strongly recommend to

customers to check arrivals in order to make reservations with the carrier if necessary.

THE RECIPIENT MUST IN THE PRESENCE OF THE DELIVER, VERIFY THE CORRECT NUMBER OF PACKAGES RECEIVED AND THE GOOD CONDITION OF THE GOODS.

Any damage observed must be the subject of specific reservations with the carrier on the delivery slip, which must be confirmed to him by registered letter with acknowledgment of receipt within 48 hours.

The mention “subject to unpacking” has no value.

Any claim to be admissible must be made in writing within eight days of receipt.

Any refusal of goods on delivery entails the payment of outward and return shipping costs, i.e. 10% of the amount excluding VAT of the invoice.

If the customer collects the goods himself, he is also obliged to check the goods for completeness, correctness and good condition immediately upon handover. Missing quantities and possible defects must be communicated without delay. Otherwise, the goods are deemed to have been received in accordance with the contract. Visible and hidden damage occurring during transport can no longer be invoked later by the customer.

If during the inspection, the customer finds that the goods do not correspond with what had been agreed in the contract, he must notify Metamorphoses in writing within two weeks of receipt of the goods. Otherwise, he cannot under any circumstances claim the guarantee. This also applies when the customer, having become aware of the defect, uses, assembles and/or puts the goods into use. It is the date on which the complaint is sent that makes it possible to determine whether the deadlines have been respected. The customer fully bears the burden of proof; this applies in particular to the defect itself, to the date of discovery of this defect and to the complaint in due time.

If the customer does not address his complaint within the deadlines, he loses all his rights to the guarantee, insofar as the defects, the differences compared to the order relating to the quantities, the errors of delivery or the deteriorations could have been established by an examination without delay and in good and due form.

Minor differences in dimensions, colors or in the production of goods do not give rise to a warranty.
In the event of a justified complaint for missing quantities, the missing goods are delivered.

In the event of proven defects, Métamorphoses chooses on its own initiative to ensure its guarantee either by repairing or replacing the said goods. If the repair fails, Metamorphoses grants the customer an appropriate price reduction.

PAYMENT

Payments are made by check or bank transfer.

Any dispute will fall within the jurisdiction of the Court of La Rochelle.

Payments are made at Créations Métamorphoses.
