TERMS OF SALES

These general conditions of sale (hereinafter CGV) apply to all orders placed online by French private and professional customers on the site www.tapisserie-decoration-rideaux.com.

Article 1 - Opposability of the T&Cs
The clauses stipulated below are brought to the attention of the customers and are the law of the parties. Placing an order implies the customer's full and unreserved acceptance of these T&Cs. Any contrary condition opposed by the client will therefore, in the absence of express acceptance by Métamorphoses, be unenforceable against Métamorphoses, regardless of when it may have been brought to its attention. The fact that Metamorphoses does not avail itself at a given time of any of the provisions of these GCS cannot be interpreted as a waiver of the right to subsequently avail itself of any of the said conditions. The customer, once connected, can simply, freely and at any time consult these GCS by clicking on the link “GENERAL CONDITIONS OF SALE”. Metamorphoses reserves the right to modify these T&Cs at any time.

Article 2 - Illustrations
The photographs illustrating the products on the Site do not enter into the contractual field. If errors or alterations resulting from the processing of these photographs are introduced, the responsibility of Métamorphoses can in no case be engaged as a result.
All these articles may also be subject to deletion or modification without notice.

Article 3: Order taking
To make your purchases: choose a product and click on the product sheet to find out about its characteristics (size, color, variations, price, etc.).
Select any options and enter the desired quantity in the “Quantity” box.
Click on "ADD TO CART".
The product is automatically added to the basket.
To view the basket, click on "View basket", allowing access to the summary of the order, indicating the price including VAT. At this time, it is possible to change quantities, cancel products, continue shopping and order by clicking on “Order”.
You will then be asked to fill in the information for the delivery, then to choose the method of payment.
To validate his order, the customer will first view the summary including any transport costs, then accept without reservation these GCS as they exist on the day of his order and of which he will have read beforehand, before clicking on " To order ".
The payment of the order constitutes an irrevocable commitment of the customer which can only be called into question in the cases limitedly provided for in these GCS (see article 9 "returns").

Following the finalization of the order, a message certifying that it has been taken into account will be displayed on the screen.
The seller reserves the right not to confirm an order for any reason whatsoever. In any case, the customer will be informed as soon as possible by the seller.
The order history is visible in the "My Account" section.

Article 4 - Pricing principles
The rates displayed are subject to change without notice depending on currency fluctuations or any impact that may affect the prices of raw materials or labor. They agree quantitatively with the color. The prices are displayed inclusive of VAT in the product sheet.
The seller reserves the right to remove items from the Site without prior notification.
The prices indicated are ex works.
Continental France and Corsica:
  a transport fee of 15 Euros including tax will be invoiced.
DOM TOM :
  an administrative fee of 12 Euros, plus postage, will be invoiced. The conditions applied to mainland France will apply for any delivery made in mainland France.
BENELUX, GERMANY, AUSTRIA, mainland SPAIN, ANDORRA and mainland PORTUGAL: an administrative fee of 15 Euros will be charged.
BALEARES: for any order, a minimum amount of 25 euros excluding taxes will be charged, including shipping costs.
CANARY ISLANDS: the prices indicated are ex works. For any order less than 200 euros, a minimum administrative amount of 15 euros will be invoiced.
The above rules are valid only for orders in which no item exceeds 300 cm. For any order in which an article exceeds 300 cm, the transport costs will be the subject of a specific quotation and will be invoiced to the buyer.
Any change in the applicable VAT rate may be passed on to the selling price of the products. For a delivery outside the European Union, the customer must pay the customs duties, VAT or other taxes due on the occasion of the importation of the products into the country of the place of delivery. The related formalities are also the sole responsibility of the customer, unless otherwise indicated. The customer is solely responsible for checking the possibilities of importing the products ordered with regard to the law of the territory of the country of delivery.

Article 5 - Delivery
The products are delivered to the address indicated by the customer.
Unless expressly stipulated, our goods are shipped by the carrier of our choice. In case of shipment by a specific carrier, the port will be the responsibility of the customer. The customer, in the event of delay in delivery, due to a strike, loss or damage, must exercise his recourse against the intermediary transport agent. The goods travel at the risk and peril of the customer, whatever the mode of transport or the methods of payment of the price of transport. It is therefore up to the recipient to check the condition upon receipt and to make all the usual reservations with the carrier, within 48 hours by registered letter AR. Delivery times are only given as an indication and any postponements can in no way give rise to a cancellation of sale, a refusal of goods and / or a claim for damages from the customer. In the event of an order for bulky products subject to the transport weight/volume rule, we reserve the right to use another carrier than the one usually used. For these same orders, a transport offer will be submitted to the customer for approval before shipping the goods.

Article 6 - Payment
The customer has the possibility of paying his order directly on the Site by bank card and by PayPal or by telephone with credit card.

Article 7 - Retention of title clause
In accordance with article 2367 of the Civil Code, the seller retains ownership of the goods delivered until full payment. Any default on any of the deadlines may result in a claim for the goods. These provisions do not preclude the transfer to the buyer, upon delivery, of the risks of loss and deterioration of the goods sold as well as the damage they may cause.

Article 8 - Return of goods
Any return of goods must be the subject of a prior written agreement on our part and each request for return must imperatively include the number and the date of the corresponding invoice within 15 days following the date of the invoice.
In any case, any product being returned must imperatively be returned complete, in its original packaging, to the following address: METAMORPHOSES - RETURN SERVICE - 21 Grande rue de la Motte - 17138 PUILBOREAU. The shipping costs relating to the return of goods will be borne by the customer if the error is attributable to him, by the seller if the error is on our part (defective goods, picking error, etc.). In this case, we ask you to consult us to agree together on the method of reshipment.
 


Article 9 - Complaints
The customer is the sole judge of the use he makes of the goods ordered and is solely responsible for the consequences resulting from this use. Defects in raw materials or hidden defects ignored by us can only oblige us to replace them pure and simple without any compensation of any kind: the replaced products remain our property. Our goods undergo a rigorous control before dispatch. However, some items may have inherent quality defects or technically unavoidable usual imperfections. Consequently, all goods must be checked before use, existing defects must be reported by the customer to Metamorphoses as soon as received and returned within 8 days of receipt. After this period, the complaint cannot be taken into consideration and the goods will be considered accepted by the customer. Complaints can only be accepted on uncut or uninstalled items. No reason for complaint constitutes a valid reason for delaying payment on the agreed due date.

Article 10 - Personal data
The personal information requested from the customer is essential for the processing and delivery of orders and the establishment of invoices. To learn more about the use of personal data, please consult our legal notices.

Article 11 - Intellectual property
Métamorphoses holds the intellectual property rights on the Site and the right to distribute the elements appearing in the Site catalog – and in particular the photographs, for which Métamorphoses has obtained the necessary authorizations from the persons concerned, or of which Métamorphoses is the author. The products themselves, as original creations, are also protected by national and international copyright laws. The models are registered.
Consequently, any total or partial reproduction of the Site and/or one of its contents is strictly prohibited.
Metamorphoses reserves the right to take legal action against any person who infringes their rights and these general conditions.

Article 12 - Dispute
These GCS, as well as all the purchase and sale transactions referred to therein, are subject to French law and interpreted according to this law.
In the event of a dispute, only the Commercial Court of La Rochelle will be competent.
